An Appelate court judge has ruled that construciton on 16 lots in the Portuguese Bend area may continue without an additional environmental survey report that is required for another 31 vacant lots in the private gated community of Portuguese Bend. The 16 lots were part of a recently decided court case that required the City of Rancho Palos Verdes to lift their building moratorium instituted because of concern of a nearby land slide area. In response to the lawsuit filed by the 16 homeowners, referred to as the "Monks" case, the City determined that just a cursory envirnomental review need be done on those lots, however required a much more extensive environmental review on 31 additional vacant lots in the area.
A Portuguese Bend homeowner , however, sued the city stating that the 16 lots should also have to undergo the more extensive environmental review.
