West Palos Verdes Neighborhood in Rancho Palos Verdes

West Palos Verdes:( Area 170 in the Multiple Listing Service map below) is an area in Rancho Palos Verdes just south of Palos Verdes Estates, and stretches south along the coastline along Palos Verdes Drive West to Hawthorne Boulevard. This area includes new luxury home developments such as Ocean Front Estates at the southern terminus of Hawthorne Boulevard. Many homes in this area enjoy excellent ocean and Catalina Island views. Neighborhoods include Lunada Pointe (adjacent to Palos Verdes Estates), Berry Hill, Point Vicente, Warmington Estates, and Oceanfront Estates.There are no condominium developments in this neighborhood.

As of September 30, 2008, there was 14 homes for sale in the West Palos Verdes Neighborhood at an average listing price of approx. $3.2 million. The average price per square foot for recent sales in this area ranges from 650 to 800 per square foot.

These prices vary quite a bit due to the range in size and quality of the homes in this area. Homes east of Palos Verdes Drive West tend to be smaller and older than the large estate homes in Ocean Front Estates or Lunada Pointe to the West of Palos Verdes Drive West.

Palos Verdes Drive South Neighborhood in Rancho Palos Verdes

Palos Verdes Drive South: (Area 169 in the Multiple Listing Service) is a neighborhood which stretches along the coastline from the border of San Pedro along Palos Verdes Drive South, including the Portuguese Bend area, north to Point Vicente Park and the western terminus of Hawthorne Boulevard. Palos Verdes Drive South is the principal road serving this area. Many of the homes in this area offer excellent ocean and Catalina views. The Portuguese Bend Club is in the center of this portion of the Peninsula, and is adjacent to the Portuguese Bend landslide moratorium area. Homes in the landslide area have restrictions on their ability to be expanded or renovated. The nearest shopping area for homes in the southern portion of this neighborhood is located in San Pedro. Golden Cove Center is located at the northern end at the intersection of Palos Verdes Drive South and Hawthorne and contains the Admiral Risty Restaurant, the Golden Lotus Restaurant a Montessori school, and many local services. The Wayfarers Chapel is also located in this area. Other smaller neighborhoods in this area include Abalone Cove, Ladera Linda, Vista Pacifica, Seacove, and Seabluff

Several condominium and townhouse projects are located in this area including the Ocean Terrace condominium project adjacent to the newly completed Trump National Golf Course at the southern end of the area, the Palos Verdes Bay Club condominiums and the Seahill and Coastsite townhomes, located just south of the new Terranea resort ( formerly Marineland/Long Point), and the Villa Capri townhomes located adjacent to the Golden Cove shopping center..

 

 

As of September 30, 2008, there were 17 homes for sale in the Palos Verdes Drive South area. As of September 30, 2008, the average asking price of homes in this area was $2.7 million.

Investing in Foreclosure Property

Some people spend a great deal of time seeking out properties that are in the foreclosure process. These are known as pre-foreclosure properties. The first source of information in seeking out these properties is to review local papers that publish notices of default or notices of sale. There are other services for a fee and pre-foreclosure data services which research the public records for properties for which a notice of default or a notice of sale have been recorded. Direct contact with the delinquent borrower may provide an opportunity to present an offer to purchase the property at a distressed price below market rates. If the borrower is not able to cure the delinquency during the 3 months subsequent to the initial recording of the notice of default, they may be willing to discuss a sale of the property in order to at least salvage some of the equity that they have in the property. Keep in mind the fact that most of these properties have a large amount of deferred maintenance issues since the borrower has probably not had the resources to properly maintain the home. California, however, has laws protecting property owners during the foreclosure process which prevents someone from taking unfair advantage of a homeowner with a property in foreclosure, as can be seen from  this excerpt from California Civil Code 1695.13, .14, and .8 taken from http://caselaw.lp.findlaw.com/cacodes/civ/1695-1695.17.html :

"1695.13. It is unlawful for any person to initiate, enter into, negotiate, or consummate any transaction involving residential real property in foreclosure, as defined in Section 1695.1, if such person, by the terms of such transaction, takes unconscionable advantage of the property owner in foreclosure.

1695.14. (a) In any transaction involving residential real property in foreclosure, as defined in Section 1695.1, which is in violation of Section 1695.13 is voidable and the transaction may be rescinded by the property owner within two years of the date of the recordation of the conveyance of the residential real property in foreclosure. (b) Such rescission shall be effected by giving written notice as provided in Section 1691 to the equity purchaser and his successor in interest..."

"1695.8. Any equity purchaser who violates any subdivision of Section 1695.6 or who engages in any practice which would operate as a fraud or deceit upon an equity seller shall, upon conviction, be punished by a fine of not more than twenty-five thousand dollars ($25,000), by imprisonment in the county jail for not more than one year, or in the state prison, or by both that fine and imprisonment for each violation."



The key in the above, is what it means to "take unconscionable advantage" of a homeowner in the foreclosure process. This does not mean that a top price needs to be paid, but it does mean that a significantly below market price, when taking all issues affecting value (such as location, interior lay-out, square footage, age of the home, condition of the home, views, etc.), negotiated with a homeowner in the foreclosure process, may expose the new buyer to not only rescission of the sale for a two year period following the sale, but also to possible criminal prosecution.

The most important piece of information when investing in foreclosed property is to know the property's market value, taking into consideration its current physical condition. It is usually a good practice to engage the services of a real estate broker when negotiating on a property in foreclosure. They can prepare a comparative market analysis (CMA) on the property, which takes into account both previous sales of comparable properties as well as other comparable properties currently listed as available for sale, and can provide support to the buyer that the price paid was a reasonable one, from both the buyers and sellers stand point.

Property Tax Savings

There are several things that property owners can do in minimizing the property taxes which they pay in Los Angeles County and the South Bay.

MAINTAINING YOUR EXISTING PROPERTY TAX BASIS IF YOU ARE 55 OR OLDER AND SELL YOUR PROPERTY
Proposition 60, passed in 1986, and modified by Proposition 90, passed in 1988, allows "qualified" individuals over the age of 55 to transfer the base year assessed valuation from a former residence ("original property") to a replacement residence, of equal or lesser value and that meet other certain conditions. Link: http://www.smcare.org/library/pdfs/Broch-Props_60-90-110_v_BG-PK.pdf which discusses this issue in detail. Effective January 1, 2007, claims must no longer be filed within 3 years, however if the claim is filed after 3 years, relief will be granted beginning with the calendar year in which the claim was filed. In addition, any upgrades paid by the buyer outside of escrow and not reflected in the sales price must now be reported on the Preliminary Change of Ownership Report so as to be included in the determination of the "equal or lesser value" test.

HOMEOWNER'S EXEMPTION ON PROPERTY TAXES
If you own a home and occupy it as your principal place of residence on January 1, you may apply for an exemption of $7000 off of your assessed value. This will save you over $70 a year on your property taxes. It is amazing to me how many property owners do not take advantage of this very simple item. All you need to do is file a simple one page form with the county tax assessors office. For information click on this link at the L.A. county assessors office: http://www.lacountyassessor.com/extranet/guides/exemptions.aspx . For a copy of the form to be filed you must call the L.A. County Tax Assessors office at (213) 974-3211 and request that a form be mailed to you. The form is not available on the internet. If you do not know if you have a homeowners exemption on file, go to the assessormap link http://assessormap.co.la.ca.us/mapping/viewer.asp, and review the property tax information for your property.

DECLINE IN VALUE
If the current market value is less than the actual assessment, the Assessor's Office may reduce the assessed value of any real property. With the recent decrease in home prices, anyone buying a property within the last 2 years should contact their realtor to obtrain support to appeal their current property assessed value.

Mira Catalina:( Area 168 in the MLS map below) is an area is between the Miraleste (Palos Verdes Drive East )area and the Palos Verdes Drive South area, and is primarily accessed by the southern portion of Palos Verdes Drive East (south of Crest Road) until it ends at Palos Verdes Drive South. Many homes in this area enjoy spectacular views of the ocean and Catalina Island. Marymont College is located in the Mira Catalina neighborhood.

Palos Verdes Drive East Neighborhood of Rancho Palos Verdes

Palos Verdes Drive East (Miraleste): (Area 167 in MLS map below) is a neighborhood on the eastern side of the Palos Verdes Peninsula and is bordered by the City of Rolling Hills on the west, the Eastview area of Rancho Palos Verdes to the east, and the Mira Catalina area to the south (south of Crest Road). Although many of the homes here have large lots, the steep terrain restricts the useability of many yards. Many of the homes in this area have city and Harbor views. Palos Verdes Drive East is the main road through the center of the neighborhood. Many of the lots in this area are zoned for horses. Neighborhoods include Miraleste Hills, Colt Road, Coach Road, Bronco, Sunnyside Ridge, Rockinghorse and Roan Road. Rolling Hills Neighborhood on the Palos Verdes Peninsula

Rolling Hills (Area 166 in the map below )  is located on the eastern side of the Palos Verdes Peninsula, one of the most beautiful residential communities in the world. The Palos Verdes Peninsula is also one of the wealthiest communities in the country, as described in the Los Angeles Business Journal.. Rolling Hills and the Palos Verdes Peninsula have an extremely interesting history . Rolling Hills is a gated community, with a ranch style/equestrian environment with an enduring respect for native wildlife and natural surroundings. Rolling Hills is a very small city totaling 3 square miles, 690 residences, and 1906 residents.Rolling Hills maintains an extensive horse trail system throughout the city totaling 23 miles, and many of the city's residences have stables and corral facilities. Because it is located on the eastern side of the Peninsula, the weather in Rolling Hills tends to be much warmer than the western side of the Peninsula, and receives much less fog.

Homes in the community of Rolling Hills tend to be ranch style homes with shake roofs, on large lots. All homes in Rolling Hills must be painted white.

As a gated community, Rolling Hills has one of the lowest crime rates in the country.

Palos Verdes Drive North Neighborhood in Rolling Hills Estates and Palos Verdes Peninsula

Palos Verdes Drive North  ( Area 165 in MLS map below) Is an area of the Palos Verdes Peninsula that extends from the eastern boundary of the city, just south of Palos Verdes Drive east, to the northern boundary of the city with Palos Verdes Estates, and is located both north and south of Palos Verdes Drive North. Neighborhhoods include Colina Ranch, Strawberry Lane, Rollingwood, Rolling Hills Road, Roanwood, Saddlebow, Palomino Ranchos, Monticello, Marloma, Masongate, Empty Saddle, Dapplegray, Club View, and Bridlewood Circle, Another area of Palos Verdes Drive North in Rolling Hills Estates is south of Palos Verdes Drive North along Palos Verdes Drive East, and includes the neighborhoods of Hitching Post, Harbor Sight and Conestoga.

Palos Verdes Peninsula: ( Area 165 in MLS map below) This residential area on either side of Crenshaw Boulevard,south of Palos Verdes Drive North, which is accessible only from Palos Verde Drive North, is not in the City of Rolling Hills Estates, but is in an unincorporated area of Los Angeles County referred to as Palos Verdes Peninsula, California. This unincorporated area consists of two neighborhoods. One is called Academy Hill, with less than 200 homes, and the other is called Westfield, with approx. 300 homes. Many of the homes in The Palos Verdes Drive North area are zoned for horses and have larger lots. There is an extensive system of horse trails in this area as well as the adjacent city of Rolling Hills. There is also a small area just south of the intersection of Rolling Hills Road and Crenshaw Boulevard, adjacent to Torrance and surrounded on three sides by Rolling Hills Estates, that is also an unincorporated area of Los Angeles County, also within the mailing address of Palos Verdes Peninsula. This area has a large condominium and townhouse project called The Estates, which has some of the more affordable hoousing units on the Palos Verdes Peninsula. These unincorporated areas, although not a part of the four cities of the Palos Verdes Peninsula, are included in the boundaries of the Palos Verdes Unified School District.
